Tried to catch up on all the kerfluffle re the deletions and I'm still not sure of exactly what happened, so I'll just suggest reading rivkat's post on legal standards and definitions and violet_quill's post today (which I don't have the url of) detailing the dialogue with Barak of 6A earlier this summer.

Will see a bunch of you tonight & tomorrow, and there will be discussion of this at the Monetization of Fandom round table that I'm hosting tomorrow morning.

Two HP fan artists were TOSsed without warning because of art work at Pornish Pixies. Neither image was Adult/Child,but both were explicitly sexual.

What she said, oh and LJ's made so any post *ever* made by a suspended journal dissapears.

But yeah the major points are:

- Elabartion and Ponderosa121 were both Tossed for what they posted on P_P

- Both their ToS notifications said it was for violating the bit of the ToS that said no graphic images with minors (you can read the exact ToS message in my LJ)

- Neither picture contained sex with minors, from what I've heard (someone linked one of the pictures in my comments, but I can't look)

Hopefully you guys and prophecy can maybe get together and think of something. We're kinda hitting a brick wall here *sigh*

Well, it is debatable about minors - but Harry is at least 16 if not older.

You know when I took sex-ed 18 was *not* the legal limit in all US states. Some where as low as 15 IIRC (ok by some I mean hawaii and I think they've sensed raised it)

Can anyone explain why everyone so often defualts to 18 for the US?

I know for sure some state are at least 17 . . . though legality doesn't transfer from one state to the other. My teacher told us a story about a couple married in one state, went outta state for the honeymoon . . . and got arressted for stuatory (sp) rape.

Errmm random story, but still what exactly are the laws on all that, just wondering. Is there a federal law?

That is the age of consent for actual people to have sex. The law for pornography is no one under 18. There is no law for fictional characters in image or fiction. That can be considered obscenity though and that is the basis LJ is using for TOSsing people.
