: yays for the Supreme COurt's refusal to reopen the Barbie Doll litigation!


Toymaker Mattel lost a Supreme Court appeal Monday over a mocking pop song that called the iconic fashion doll Barbie a "blonde bimbo."

The high court did not comment in turning down Mattel's request to reopen a trademark fight over the 1997 dance hit "Barbie Girl." Mattel claims the preteen girls who buy Barbie dolls were duped into thinking the song was an advertisement for the doll or part of Mattel's official line of Barbie products.


I think one of the lines from the lower court case ruling in this matter will have to become the tagline for the website that [livejournal.com profile] praetorianguard and [livejournal.com profile] tabithajones and I are working on, which will be a companion piece to our Nimbus - 2003 presentation.

The parties are advised to chill.

This review needs to be read by everyone who (a) thinks fanfic isn't inherently at least prone to be a pastiche, (b) enjoys the concept of "meta", and/or (c) has issues with quoting television serieses in fanfics that take place in other universes.
