: yays for the Supreme COurt's refusal to reopen the Barbie Doll litigation!

Toymaker Mattel lost a Supreme Court appeal Monday over a mocking pop song that called the iconic fashion doll Barbie a "blonde bimbo."

The high court did not comment in turning down Mattel's request to reopen a trademark fight over the 1997 dance hit "Barbie Girl." Mattel claims the preteen girls who buy Barbie dolls were duped into thinking the song was an advertisement for the doll or part of Mattel's official line of Barbie products.

I think one of the lines from the lower court case ruling in this matter will have to become the tagline for the website that [livejournal.com profile] praetorianguard and [livejournal.com profile] tabithajones and I are working on, which will be a companion piece to our Nimbus - 2003 presentation.

The parties are advised to chill.

So spoketh Judge Alex Kozinski

So, [livejournal.com profile] rivkat and [livejournal.com profile] ajhalluk, comments?

I adore Kozinski. I think we've been over this, but it may have been [livejournal.com profile] rivkat and I. *shrugs* He rocks at any rate.

Is there a law against keeping 9th Circuit judges in your pocket to pull out when you need legal analysis?

I second the sentiment. I love Kozinski to death. His dissent in the Vanna White case ranks high up there on my list of entertaining court opinions. And yes, I realize this makes me a big sad dork :D

Great decision. More judges should write like Kozinski. He's funny and right (as opposed to Scalia who's funny and wrong most of the time).

He really said that in the ruling? I love it and, by the way, you rock, babe! Thank you for the FA birthday thread. That just floored me...

Can't wait for Nimbus!

Too bad all judges aren't like that, might end some of the more frivolous law suits.
