Well, the civil union of marriage is a legal act. I'm not a lawyer and may not be stating this correctly, but now, legally, there is no reason in the state of MA to deny two people of the same sex a licensce for marriage. Except that Gov Mitt opposes it, and will be filing an amendament soon. Congrats go out to all of you in committed relationships here in the baystate. Have a glass of champagne for me!!
If you read the links, one of them specifically states:
The highest court in Massachusetts ruled Tuesday it is unconstitutional for the state to deny marriage to gay and lesbian couples, a move that could make the state the first to legalize same-sex marriages.
In other words, the ban is gone, yes. Is it legal? Maybe.
My boss is head of the RI Alliance, and she knows that wording is everything. :)

As I understand it, Vermont has civil unions, and Hawaii had one or the other (can't remember which) for a very short time until a referendum changing the constitution to allow discrimnation went through. But this is off the top of my head and I may not be entirely correct.
