Try letting the battery die completely and don't touch it for about 12 hours. The do what was described above as a reset. Then recharge completely. I had this happen to me a few months ago and it worked. Actually, I went to the apple website forum and got the info from there although I didn't wait 12 hours, it still worked.
Resetting the Ipod could work. Letting the battery run dry, then recharge it, (maybe you even have to repeat that process) could work. Restoring the software (which would result in losing all your data), is very likely to work. Using your one-year-warranty just has to work too.
Isn't it scary that I know all this despite owning a working iPod for only a week?

--toggle the HOLD switch on and off (set to HOLD, then turn it off again)
--press and hold the Play/Pause and Menu buttons for at least 5 seconds until the Apple logo appears
